Divorce

A divorce can only be granted by a court.  

There are two main reasons to get a divorce.

1. You cannot marry anyone else until you have a valid divorce. So anyone who wants to get remarried must have a divorce.

2. It provides closure for people.

UNCONTESTED DIVORCES WITH NO OTHER ISSUES:

WHEN CAN YOU GET A DIVORCE?

The court will not grant a couple of divorce until a couple has been separated at least one year. Sometimes the date of separation is in dispute.

However, it is possible that you can live under the same roof and be separated.

You can start a divorce application before the one year is up,  but you can’t get the actual divorce order until the year has passed.

DIVORCES ARE A  2 OR 3 STAGE PROCESS

Divorces begin with a divorce application. It can be a simple application or an application together with other elements or claims.

The granting of a divorce is through a motion for divorce. It requires:  

  1. an affidavit for divorce
  2. a motion for divorce
  3. draft orders
  4. a fee of $420.00 paid to the court to set it down.

There are lots of reasons a court may not grant you a divorce the first time you ask.

If you are in the middle of a family law litigation, you can sometimes consent to have a divorce issue in the middle of the application.  This is called severing the divorce from the corollary relief.
